Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of CrewBoss, operated by Custom AI Apps LLC ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

CrewBoss is a cloud-based business management platform designed for lawn care, tree service, and landscaping companies. The Service includes job scheduling, customer management, invoicing, crew management, equipment tracking, AI-powered business insights, and related features.

3. Accounts and Registration

To use CrewBoss, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

You must be at least 18 years old to create an account.

4. Subscription and Billing

Free Trial: New accounts receive a 14-day free trial with full access to features. No credit card is required to start a trial.

Paid Plans: After the trial period, continued use requires a paid subscription. Plans are billed monthly or annually as selected at checkout.

Payment: All payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Price Changes: We reserve the right to modify pricing with 30 days' notice. Price changes will not affect your current billing period.

5. Your Data

You retain full ownership of all data you enter into CrewBoss ("Your Data"). We do not claim any ownership rights over Your Data.

You grant us a limited license to store, process, and display Your Data solely to provide the Service to you. This license terminates when you delete your data or close your account.

You are responsible for ensuring you have the right to enter and process any personal data of your customers, employees, or other individuals through the Service.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to other accounts or our systems
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to store or transmit malicious code
• Interfere with or disrupt the integrity or performance of the Service
• Resell, sublicense, or redistribute the Service without written permission
• Use automated systems to excessively access the Service

7. AI Features

CrewBoss includes AI-powered features that generate content, insights, and recommendations based on your business data. You acknowledge that:

• AI-generated content is provided for informational purposes and may contain errors
• You are responsible for reviewing and verifying AI outputs before acting on them
• AI features rely on third-party services and may have occasional downtime
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned downtime when possible.

9. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Custom AI Apps LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUSTOM AI APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Custom AI Apps LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. Upon termination, your right to use the Service ceases immediately. Your data will be retained for 30 days following termination to allow for export, after which it will be permanently deleted.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Texas.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
